{"id":19882,"date":"2021-12-16T22:56:16","date_gmt":"2021-12-17T03:56:16","guid":{"rendered":"https:\/\/projectcalls.com\/dev?p=19882"},"modified":"2021-12-16T17:57:17","modified_gmt":"2021-12-16T22:57:17","slug":"house-considers-procurement-bill","status":"publish","type":"post","link":"https:\/\/projectcalls.com\/dev\/house-considers-procurement-bill\/","title":{"rendered":"House considers procurement bill"},"content":{"rendered":"<p>British Virgin Islands<\/p>\n<p>A proposed new procurement law is designed to promote international commerce while ensuring that the government\u2019s contractor selection process is transparent and fair to Virgin Islands businesses, according to Premier Andrew Fahie.<\/p>\n<p>Mr. Fahie brought the\u00a0Public Procurement Act, 2021\u00a0for a second reading on Nov. 1 in the House of Assembly, and legislators debated it before heading into closed-door committee for the remainder of the day\u2019s proceeding.<\/p>\n<p>In recent months, the ongoing Commission of Inquiry has been highly critical of the government\u2019s procurement methods, raising concerns about\u00a0practices such as widespread contract splitting and tender waivers.<\/p>\n<p>But Mr. Fahie said on Nov. 1 that the Public Procurement Act and other good-governance measures working their way through the House had been in the works since before the COI.<\/p>\n<p>HOA members reconvened Wednesday afternoon after the\u00a0<em>Beacon<\/em>\u2019s print deadline.<\/p>\n<article id=\"post-28280\" class=\"post-28280 post type-post status-publish format-standard has-post-thumbnail hentry category-local-news tag-contracting tag-hoa tag-house-of-assembly tag-procurement tag-procurement-reforem tag-public-procurement-act\">\n<div class=\"entry-content\">\n<h5><strong>Fair treatment<\/strong><\/h5>\n<p>The bill is designed to \u201cprovide for the fair, equal and equitable treatment of all tenderers,\u201d according to a draft published in the\u00a0<em>Gazette<\/em>.<\/p>\n<p>To that end, it would \u201cfoster and encourage participation in public procurement proceedings by tenderers regardless of nationality, thereby promoting international trade.\u201d<\/p>\n<p>At the same time, however, it would also seek to \u201censure that BVI tenderers are provided with ample procurement opportunities in order to encourage and support national development,\u201d the draft states.<\/p>\n<p>The bill would repeal part of the Public Finance Management Act 2004 but keep a five-member Central Tenders Board chaired by the financial secretary to review tender evaluations; make recommendations to Cabinet on projects; register classified companies; make policy recommendations; keep abreast with worldwide environmental and sustainability development standards; and work to eventually turn procurement into a digital process, among other responsibilities.<\/p>\n<p>\u201cThere is no question that your government, all members of this House on both sides of the aisle, and the members of the public \u2014 especially those who provide goods and services to the government and to the various state agencies \u2014 all want a procurement system that is fair, that is transparent and promotes value for money whilst empowering local contractors and businesses to be successful,\u201d the premier said on Monday. \u201cWe all want a procurement system that we can have confidence in.\u201d<\/p>\n<p>He noted that the legislation has been in the works across multiple administrations.<\/p>\n<p>In June, the House also passed the Contractor General Act 2021, which would create an independent office to oversee and investigate how government contracts are awarded.<\/p>\n<p>That bill, however, has not yet received assent from the governor.<\/p>\n<h5><strong>Tendering<\/strong><\/h5>\n<p>During Monday\u2019s debate, lawmakers stressed the importance of ensuring that VI contractors have adequate opportunities to compete for tendered projects and have access to resources that will help them grow enough to bid on larger contracts.<\/p>\n<p>The proposed law requires state-owned enterprises to \u201censure that BVI tenderers are provided with ample procurement opportunities in order to encourage and support national development.\u201d<\/p>\n<p>Junior Minister for Trade and Economic Development Shereen Flax-Charles said this support should start at an early stage, including programmes for high schoolers interested in learning more about architecture and construction.<\/p>\n<p>Under the proposed law, the government would be able to seek goods and services using various approaches based on the size and complexity of the project.<\/p>\n<p>These approaches include open tendering, restricted tendering, requesting quotations, requesting proposals without negotiation, requesting proposals with consecutive negotiations, and single-source procuring.<\/p>\n<p>The bill sets out specific conditions for when each procurement method should be used.<\/p>\n<h5><strong>Emergencies<\/strong><\/h5>\n<p>The bill also makes special provisions for relaxing certain rules to allow single-source procurement in the event of a natural disaster, public health emergency, or other exceptional circumstance.<\/p>\n<p>Such special procurements should \u201cbe limited to the period of the emergency,\u201d according to the bill.<\/p>\n<p>As of\u00a0<em>Beacon<\/em>\u00a0press time yesterday, the bill had not yet to come for a vote in the House, but every representative who spoke on Monday lent their support.<\/p>\n<p>Besides the premier and Ms. Flax-Charles, they included Deputy Premier Dr. Natalio \u201cSowande\u201d Wheatley;
